Terms and Conditions of Sale

The terms governing the use of the site and the booking of our services.

1. Subject Matter and Scope

These General Terms and Conditions of Sale (GTC) govern the sale of trips, package tours and travel services (Umrah, Hajj, combined trips, stays and accommodation) as well as purchases from the online shop, offered by IBN BATTUTA VOYAGES, a limited liability company (SARL) with a share capital of €7,000, trading under the commercial name GO-Makkah, SIREN 790 357 875, registered in the register of travel and stay operators with Atout France under number IM075130054, with its registered office at 32 avenue Pierre Sémard, 94200 Ivry-sur-Seine.

The sale of package tours is subject to Articles L.211-1 et seq. and R.211-1 et seq. of the Tourism Code. Prior to the conclusion of the contract, the traveller receives the standard information form provided for by the Order of 1 March 2018 as well as the pre-contractual information relating to their trip.

The travel contract consists of these General Terms and Conditions of Sale and the specific terms (accepted quote and signed contract). In the event of any conflict, the specific terms shall prevail. The customer declares that they are of legal age and have the capacity to enter into a contract, on their own behalf and on behalf of all persons included in the same booking.

2. Use of the website

The website go-makkah.com allows you to browse our offers, request a quote, book and pay online, as well as purchase items from the shop. The user undertakes to provide accurate and up-to-date information, to maintain the confidentiality of their login credentials and to use the website for personal use only, in accordance with the law. Any extraction or commercial reuse of content is prohibited.

3. Quote, Booking and Contract Formation

Every booking is subject to a quote specifying the services, dates, price and applicable conditions. The contract is formed upon signing the travel contract — where applicable by electronic signature, in accordance with articles 1366 and 1367 of the Civil Code — and upon payment of the deposit. Places and rooms are only guaranteed upon confirmation of the booking.

The personal details of each participant (identity and travel documents) must be provided no later than 31 days before departure. Contracts concluded electronically for an amount equal to or greater than 120 € are archived for 10 years; they are accessible upon simple request.

4. Pricing

Prices are quoted per person, inclusive of all taxes, in the currency of the offer. They include the services described in the quote. Unless otherwise stated, the following are not included: visa fees, the mandatory tax and medical insurance required by the Saudi authorities, optional insurance, personal expenses and administration fees. These amounts, where known, are indicated in the quote.

In accordance with Article L.211-12 of the Tourism Code, the price may only be revised, upward or downward, to reflect changes in the cost of fuel, taxes and charges, or exchange rates applicable to the trip. Any revision is notified no later than 20 days before departure. Where the revision exceeds 8% of the total price, the traveller may accept the change or terminate the contract without charge, under the conditions set out in Article 10.

5. Payment Terms

  • A deposit of 50% of the total price is due upon signing of the contract.
  • The balance is payable no later than 31 days before departure. For any booking made less than 31 days before departure, the full price is due immediately.
  • Accepted payment methods: bank card via our secure payment page, bank transfer, ANCV holiday vouchers and cash within the legal limit (€1,000 for a French tax resident, €15,000 for a non-resident).
  • If payment is not received by the due date, the customer will be sent a formal notice by email; if payment is not made within 48 hours, the booking may be cancelled and the cancellation fees set out in Article 8 will apply.

6. Administrative and Health Formalities

Each traveller, including minors, must hold a passport valid for at least 6 months beyond the return date, in their exact name, identical to the one on the booking. It is the traveller's responsibility to comply with the entry and health requirements imposed by the Saudi authorities, in particular vaccination against meningitis, and those of their country of nationality.

GO-Makkah carries out the visa procedures on behalf of the traveller, without being able to guarantee the authorities' decision. A visa or authorisation refusal, or a document deficiency attributable to the traveller, is equivalent to a cancellation on their part and gives rise to the charges set out in Article 8. Any name correction after tickets have been issued is charged at €60 per person, in addition to any costs actually incurred.

7. No right of withdrawal

In accordance with Article L.221-28, 12° of the Consumer Code, the right of withdrawal does not apply to transport, accommodation and leisure services provided on a specific date or according to a set schedule. Travel bookings therefore carry no withdrawal period. Online shop purchases are governed by Article 16.

8. Cancellation by the Traveller

The traveller may cancel the contract at any time before departure. The request must be sent by e-mail to [email protected] or by registered letter with acknowledgement of receipt; the date of receipt determines the applicable cancellation fees, calculated per person on the total price of the trip:

The following are never refundable: insurance premiums, visa and administration fees, as well as optional services from the moment of booking. Failure to show up at departure is equivalent to a 100% cancellation.

In accordance with article L.211-14 II of the Tourism Code, the traveller may however cancel the contract free of charge before departure when unavoidable and extraordinary circumstances occurring at the place of destination or in its immediate vicinity have significant consequences on the performance of the trip. The traveller is then fully reimbursed, without additional compensation.

We strongly recommend taking out cancellation insurance (article 13).

9. Transfer of contract

In accordance with Article L.211-11 of the Tourism Code, the traveller may transfer their contract to a person meeting the same conditions, provided they notify GO-Makkah by any means allowing acknowledgement of receipt no later than 7 days before departure. The transferor and the transferee are jointly and severally liable for the payment of the outstanding balance and any additional costs, in particular for the issuance of new tickets, the amount of which is communicated before the transfer.

10. Amendments by the Organiser

GO-Makkah may make minor amendments to the contract before departure; the traveller is informed in a clear and prominent manner. If GO-Makkah is compelled to modify a main characteristic of the trip or to increase the price by more than 8%, the traveller is informed without delay and may, within the indicated timeframe, accept the modification or terminate the contract at no cost. In the event of termination, the sums paid are refunded within 14 days (Article L.211-13 of the Tourism Code).

11. Cancellation by the Organiser

If the minimum number of participants specified in the contract is not reached, GO-Makkah may cancel the trip by notifying the traveller no later than 20 days before departure for a trip of more than 6 days, 7 days for a trip of 2 to 6 days, and 48 hours for a trip of less than 2 days. GO-Makkah may also cancel the trip in the event of exceptional and unavoidable circumstances, notifying the traveller as soon as possible.

In such cases, the traveller is fully refunded within 14 days, with no additional compensation. A credit note may be offered in lieu of the refund; the traveller remains free to decline it.

12. Accommodation, transport and travel arrangements

Hotel classifications follow local standards and may differ from European norms. Triple and quadruple rooms may be double rooms fitted with additional beds. Sharing a room with persons not included in the booking may result in a change of room type and an additional charge.

Schedules, itineraries and airlines are provided for information purposes only and may be modified by carriers. Rights to compensation provided for under Regulation (EC) No 261/2004 in the event of delay, cancellation or denied boarding must be exercised directly with the airline concerned. The travel booklet is issued no later than 7 days before departure.

13. Insurance

No insurance is included in the price, unless otherwise stated in the quote. GO-Makkah offers a comprehensive insurance policy (cancellation, assistance, repatriation, baggage) whose policy document is provided prior to taking out the policy. The traveller who declines all insurance is invited to confirm this in writing. It is noted that certain bank cards include travel insurance guarantees.

14. Liability and Assistance

In accordance with Article L.211-16 of the Tourism Code, GO-Makkah is strictly liable for the proper performance of the travel services set out in the contract. Its liability is excluded where the damage is attributable to the traveller, to a third party unconnected with the provision of services in an unforeseeable or unavoidable manner, or to exceptional and unavoidable circumstances.

Except in cases of personal injury or damage caused intentionally or through negligence, damages are limited to three times the total price of the trip. GO-Makkah provides appropriate assistance to travellers in difficulty, in accordance with Article L.211-17-1 of the Tourism Code. Assistance is available 24/7 during the trip at +33 6 22 19 07 09 (call or WhatsApp).

15. Claims and Mediation

Any non-conformity identified during the trip must be reported without delay to our teams so that it can be remedied. Claims must be submitted in writing, preferably within 30 days of return, to [email protected] or by registered letter to IBN BATTUTA VOYAGES, 32 avenue Pierre Sémard, 94200 Ivry-sur-Seine. We acknowledge receipt within 5 working days and respond within 30 days.

In the absence of a satisfactory response within 60 days, the traveller may refer the matter free of charge to the Médiation Tourisme Voyage (MTV), BP 80 303, 75823 Paris Cedex 17 — www.mtv.travel.

16. Online shop

Items in the shop are offered subject to available stock. Photographs are as accurate as possible, without any guarantee of perfect likeness, particularly regarding colours. Prices are shown inclusive of tax, excluding delivery charges specified before order confirmation. A 5% discount is granted for the purchase of more than 10 units of the same item.

The order is confirmed by e-mail. Delivery times are indicated before purchase; if the delay exceeds 30 days, the customer may cancel the sale. The risk of loss or damage is transferred to the customer when they take physical possession of the items.

The customer has 14 days from receipt to exercise their right of withdrawal, without having to provide a reason, by returning the items unused and in their original packaging; return costs are at the customer's expense. Reimbursement takes place within 14 days of receipt of the returned items. Items benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

17. Personal Data

The data collected at the time of booking is necessary for the organisation of the trip and may be transmitted to service providers and the authorities at the destination. Their processing and your rights are described in our privacy policy.

18. Intellectual Property and Customer Reviews

The website content is protected by intellectual property law; any reproduction without authorisation is prohibited. By submitting a review or testimonial, the customer authorises GO-Makkah to reproduce it, free of charge and on a non-exclusive basis, across its communication channels, accompanied by the first name provided. Published reviews reflect the opinions of their authors.

19. Applicable Law and Disputes

These General Terms and Conditions of Sale are governed by French law. In the absence of an amicable resolution or mediation, any dispute falls under the jurisdiction of the competent French courts; the consumer may, at their discretion, bring their case before the court of the place where they resided at the time of conclusion of the contract or at the time the harmful event occurred.

GO-Makkah may amend these General Terms and Conditions of Sale; the applicable version is the one in force at the date of booking.
